When can a minor remain on licensed premises?
Restaurants:
Minors are allowed to remain on the premises of a business that holds a Restaurant Cafe Licence. This is between the hours of 7am and 11pm Monday to Saturday; 10am and 11pm Sundays and 12 noon to 11pm on Good Friday and Anzac Day.
Other
For all other licence types (and restaurants outside the hours noted above) a minor can remain on licensed premises if they are:
- in the company of a responsible adult; or
- on the premises for the purpose of having a meal; or
- a resident of the premises; or
- engaged in a training program or work experience.
What is the definition of a Responsible Adult?
A person who is over 18 years of age and who is:
- a) the younger person's parent, step-parent, guardian or grandparent; or
- b) the younger person's spouse; or
- c) a person who is acting in place of a parent and who could reasonably be expected to exercise responsible supervision of the younger person.
